INTRODUCTION

EPR E-waste - Overview

Extended Producer Responsibility (EPR) refers to the Producer and manufacture’s responsibility for taking care of a product and ensuring its environmentally friendly management throughout its entire life. EPR is essentially a waste management concept that encourages producer and manufactures to create products and manufacturing methods that are eco-friendly and easily recyclable. Here, producers are individuals or entity involved in selling electrical and electronic equipment. This includes those who Make and sell these products under their own brand, or Sell assembled products under their brand made by others, or Sell imported electrical and electronic equipment, or Import used electrical and electronic equipment.

According to the EPR E-Waste (Management) Rules of 2022 the Extended Producer Responsibility (EPR) Framework is a set of rules for handling electronic waste. These rules apply to four types of entities: manufacturers, producers, refurbishers, and recyclers. To follow these rules, these entities must register on an online portal created by the Central Pollution Control Board. If an entity falls into more than one category, they need to register separately for each. It's not allowed for any entity to conduct business without being registered. Additionally, entities on the portal can only work with others who are also registered, and not with those who are not. Now talking about their responsibilities they need to follow as given below.

EPR REGISTRATION FOR MANUFACTURER'S RESPONSIBILITIES

1. Register on the portal.
2. They have to ensure that they will recycle and fulfill the EPR compliance with the registered recyclers.
3. Submit annual and quarterly returns on the portal by the end of the following month.

EPR REGISTRATION FOR PRODUCER'S RESPONSIBILITIES

1. Register on the EPR portal.
2. Meet Extended Producer Responsibility (EPR) targets through the portal.
3. Create awareness through various means of communication regarding EPR obligations.
4. Ensure recycling and fulfillment of EPR compliance through registered recyclers.

EPR FOR RECYCLER'S RESPONSIBILITIES

1. Register on the EPR portal.
2. Follow standards for facility operations and recycling processes as prescribed by the Central Pollution Control Board (CPCB).
3. Fulfill EPR compliance obligations on behalf of producers and manufacturers.
4. Maintain records of e-waste handling activities on the portal and provide them for verification when required.
5. Accept non-listed e-waste for recycling, provided it does not contain radioactive material, and report the same on the portal.

EPR REGISTRATION PROCESS FOR E-WASTE

1. Application Process
  • Producers must apply for EPR registration through the designated online portal.
  • Only online applications are accepted; physical submissions are not permitted.
  • The complete application must be submitted via the official portal.
2. Registration Validity
  • The EPR Registration Certificate is valid for five years from the date of issuance.
  • Producers must apply for renewal at least 120 days before expiry.
3. Application Requirements
  • Basic company details and information on electrical and electronic equipment (EEE) placed in the market each financial year.
  • EEE details must be provided in terms of weight and average end-of-life.
  • Self-declaration for RoHS compliance and availability of documents as per EN 50581.
  • Submission of an awareness plan as per Rule 6(3).
4. Processing and Approval
  • Applications received on the portal are reviewed by the concerned CPCB division.
  • The application is processed internally and submitted to the Competent Authority, CPCB.
  • Upon approval, the EPR Registration Certificate is issued through the portal.
5. Incomplete Applications
  • Any shortcomings are communicated through the portal within 25 working days.
  • The producer must respond within 7 working days.
  • After response, the application is processed further as per approval procedure.
6. Issuing Registration
  • CPCB issues registration within 30 working days after receiving a complete application.
7. Verification and Clarification
  • CPCB may issue a digital checklist of shortcomings through the portal.
  • Producers can view the checklist by logging into the portal.
  • Clarifications can be discussed during scheduled EPR Camp sessions via video conferencing.
8. Granting Registration
  • CPCB may grant registration and issue the EPR Registration Certificate.
  • The certificate includes EPR targets and compliance obligations.
9. Registration Fee
  • Producers must pay the registration fee as decided by the Central Board in its 194th Board Meeting.
